1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the website, platform, wallet system, products, and services made available through waly.com.my (collectively, the “Services”), which are owned and operated by:

By accessing, browsing, registering an account, topping up Wallet Credit, placing any order, uploading any file, or otherwise using the Services, you agree to be bound by these Terms.

If you place an order on behalf of a business, company, or other entity, you represent and warrant that you have the authority to bind that entity, and references to “you” in these Terms shall include that entity.

1.1 Definitions

For the purpose of these Terms:

  • “Working Days” means Monday to Friday, excluding Saturdays, Sundays, and public holidays applicable in Perak and Malaysia.
  • “Wallet Credit” means any monetary value, store credit, promotional credit, bonus credit, or other credit balance reflected in your account for use on the website.

2. Scope of Services

We provide online printing, fabrication, and related production services based on customer-submitted files, including but not limited to banners, buntings, backdrops, signboards, stickers, large format prints, billboards, zigzag banners, DTF, UV DTF, and such other products or services as may be made available on the website from time to time.

We act strictly as a production and processing service provider unless expressly agreed otherwise in writing.

We do not provide design consultancy, proofreading, brand consultancy, legal compliance review, advertising compliance review, permit application service, or content verification services unless expressly stated otherwise in writing.

3. Amendments to Terms

We reserve the right to amend, update, vary, or replace these Terms at any time without prior notice. The latest version published on the website shall apply. Your continued use of the Services after any such update constitutes your acceptance of the updated Terms.

4. Account, Wallet, Payment, and Pricing

4.1 Account

You may be required to create an account to access certain features of the Services. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

We may suspend, restrict, or terminate any account that is inaccurate, misleading, dormant, abusive, fraudulent, unlawful, or otherwise creates operational, reputational, or legal risk.

4.2 Wallet Credit

The website may allow you to top up and maintain Wallet Credit for future purchases.

Unless otherwise required by law or expressly approved by us in writing:

  • Wallet Credit is non-transferable;
  • Wallet Credit is not redeemable for cash;
  • promotional credit, bonus credit, and campaign credit are strictly non-refundable and non-transferable.

For paid top-up Wallet Credit, we reserve the right, to the extent permitted by law, to impose an expiry period of twenty-four (24) months from the date of the last wallet activity, including top-up, purchase, or other qualifying use.

For promotional credit, bonus credit, and campaign credit, we reserve the right, to the extent permitted by law, to impose an expiry period of six (6) months from the date of issuance, unless otherwise stated in the relevant promotion.

We reserve the right to correct wallet errors, reverse wrongly credited amounts, suspend wallet use, and reject suspicious transactions where abuse, fraud, system error, chargeback abuse, unauthorised use, or other irregular activity is detected.

4.3 Payment

Orders may be paid by:

  • direct per-order payment; or
  • Wallet Credit.

Payments shall be made through the payment methods and gateways made available on the website, including iPay88 or such other provider as we may designate from time to time.

An order is not considered accepted for processing until payment has been successfully received, verified where necessary, and reflected in our system.

4.4 Pricing

All prices displayed are subject to change without prior notice. Prices, promotions, product availability, specifications, turnaround times, and production schedules may be revised at any time.

Unless explicitly stated otherwise, all prices are exclusive of Sales and Service Tax (SST) and any other applicable governmental taxes, duties, levies, charges, compliance-related fees, or statutory impositions, all of which shall be borne by you.

Where required by applicable law, regulation, or tax administration requirements, we may issue invoices, e-invoices, credit notes, debit notes, or other tax documents based on the information provided by you, and you shall be solely responsible for ensuring that such information is complete, accurate, and up to date.

5. Order Placement and Acceptance

By placing an order, you confirm that:

  • all order details submitted by you are complete and accurate;
  • the uploaded files are the correct files for production;
  • you have reviewed the product configuration, dimensions, material, quantity, finishing options, delivery details, and all special instructions before checkout.

We reserve the right, at our sole discretion, to reject, cancel, hold, refuse, or suspend any order, including where:

  • the file is unusable, corrupt, incomplete, or technically unsuitable;
  • the content may be unlawful, infringing, misleading, defamatory, or non-compliant;
  • pricing, system, or stock errors occurred;
  • payment is not properly received or verified;
  • the order appears fraudulent, abusive, suspicious, or commercially unreasonable;
  • production is not feasible due to machine, material, manpower, technical, or operational limitations.

6. Artwork Submission and Customer Responsibility

6.1 Customer Is Fully Responsible

You are solely and fully responsible for all files, artwork, data, and content submitted by you, including but not limited to:

  • spelling;
  • grammar;
  • wording;
  • names;
  • numbers;
  • measurements;
  • scale;
  • proportions;
  • layout;
  • design placement;
  • cut lines;
  • bleed;
  • resolution;
  • transparency;
  • overprint settings;
  • colour mode;
  • file layering;
  • white ink layers; and
  • suitability for print output.

We do not review artwork word-by-word or content-by-content.

6.2 No Design Checking Obligation

Any file checking, technical screening, or basic internal review performed by our team is a courtesy only and does not amount to proofreading, design approval, content verification, or acceptance of responsibility.

Even if our team occasionally identifies a possible issue and informs you, this does not create any ongoing duty for us to identify the same or any other issue in any current or future order.

You may not claim against us on the basis that:

  • we should have noticed an error;
  • we noticed an earlier error in another order; or
  • we previously reminded you of an issue but did not do so again.

6.3 We Print Based on What You Submit

Unless expressly agreed otherwise in writing, we will process and print based on the file and instructions submitted by you.

  • Wrong file = wrong print.
  • Incomplete file = incomplete result.
  • Customer error is not factory error.

6.4 Multiple Quantities with One File

If you order multiple units or quantities but submit only one design file, layout, artwork, or name set, all units may be produced using that same submitted file unless clearly stated otherwise by you and expressly accepted by us.

6.5 File Storage and Retention

We are not a file storage, archival, or backup service.

Submitted artwork, print files, and related production files may be deleted, overwritten, or removed from our systems at any time after the order is completed. Without prejudice to the foregoing, we are under no obligation to retain any file beyond thirty (30) days after order completion.

We are not obligated to archive your files for future repeat orders or reprints. It is solely your responsibility to maintain your own backup copies of all files and artwork.

7. Preview, Proof, and Confirmation

7.1 No Automatic Preview

If your submitted files appear technically acceptable based on our internal handling process, no preview or proof will be provided.

7.2 Preview Only When Necessary

A preview may be provided only if our team considers the order unclear, incomplete, confusing, or requires confirmation, or if we otherwise decide to provide one at our sole discretion.

7.3 Final Confirmation

Where a preview is provided, once you confirm the preview, the order shall be treated as final, approved, and locked.

After confirmation:

  • no changes are allowed;
  • no new file replacement is allowed;
  • no design amendment is allowed; and
  • no refund will be given merely because you failed to review the preview carefully.

8. Non-Response by Customer

If clarification, confirmation, or additional information is required from you, we may contact you using the contact details provided in your account or order.

If you fail to respond within two (2) Working Days, we reserve the right, at our sole discretion, to:

  • proceed with production based on the available file, information, and assumptions reasonably made by us; or
  • hold, reject, or cancel the order.

You agree that any delay, error, defect, or undesired outcome arising from your non-response shall be your responsibility.

9. Production Timeline and Urgent Orders

Orders are generally reviewed by our service team before entering production. In normal circumstances, an order may enter production within approximately one (1) Working Day, but this is only an estimate and not a guarantee.

We reserve the right to start production at any time after an order is accepted and paid, without further notice.

Urgent orders may be discussed with our service team, but all urgent handling remains subject to actual machine availability, manpower availability, current queue, material availability, technical limitations, and operational conditions. No urgent job is guaranteed unless expressly confirmed by us in writing.

10. Cancellation, Changes, and Order Lock

10.1 Before Production

If an order has not yet entered production, you may submit a cancellation request. Any such request is subject to our review and approval, and we reserve the right to accept or reject the request at our sole discretion.

10.2 After Production Starts

Once an order has entered production, it is strictly non-cancellable and non-changeable.

This includes, without limitation:

  • design change;
  • wording correction;
  • quantity reduction;
  • size change;
  • colour change;
  • material change;
  • finishing change;
  • shipping address change affecting fulfilment; or
  • refund request based on customer mistake.

10.3 Administrative Costs

Where a cancellation is approved before production, we reserve the right to deduct reasonable administrative, manpower, layout, material preparation, processing, gateway, or transaction charges.

Any approved refund may be returned by Wallet Credit, original payment method, bank transfer, or any other mode determined by us in our sole discretion, unless otherwise required by law.

11. Product Characteristics, Industry Standards, and Tolerances

You acknowledge and accept that printing and fabrication are industrial processes, not perfect duplication processes. Minor variations, limitations, and imperfections are normal and accepted in the industry.

11.1 Size and Finishing Tolerance

Unless otherwise expressly agreed, reasonable production tolerances apply to all products, including tolerances in:

  • size;
  • cutting;
  • trimming;
  • alignment;
  • positioning;
  • finishing;
  • sewing;
  • joining;
  • mounting;
  • gluing; and
  • hand-finished areas.

Slight variation shall not be considered a defect.

11.2 Colour Variation

Printed colour may vary from:

  • on-screen colour;
  • digital mockup colour;
  • previous batch colour;
  • previous order colour;
  • sample photo colour; and
  • your expectation.

Exact colour matching is not guaranteed unless expressly agreed in writing as a specific paid service.

11.3 Repeat Order Variation

Repeat orders may vary due to:

  • ink batch differences;
  • material differences;
  • machine conditions;
  • environmental conditions;
  • drying conditions;
  • operator handling; and
  • file export differences.

We do not guarantee that repeat orders will be identical to any previous order.

11.4 Large Format Viewing Expectation

Large format printing is commonly intended to be viewed from a reasonable distance. Minor marks, finishing effects, texture, or print characteristics that may appear more visible at very close range may not constitute a defect.

11.5 Light Colour, Gradient, and Line Effects

For certain materials, machines, inks, file designs, light colours, gradient areas, or large solid backgrounds, faint lines, banding, texture, roller marks, pressure marks, light smudges, or similar output characteristics may occur and shall be regarded as normal industry limitations unless clearly excessive and proven to result from abnormal production negligence.

11.6 Sample Images

Product images, mockups, previews, and website displays are for illustration only and may not represent exact real-life output.

11.7 Application of DTF and UV DTF Products

For products requiring self-application, self-transfer, self-pressing, self-peeling, installation, or handling by you or any third party, including but not limited to DTF and UV DTF products, our responsibility is limited to the print output supplied by us.

We shall not be liable for any failure, damage, defect, poor adhesion, lifting, peeling, cracking, misapplication, or unsatisfactory result caused by or related to:

  • incorrect temperature;
  • incorrect pressure;
  • incorrect pressing duration;
  • incorrect peeling technique;
  • unsuitable surface or substrate;
  • contamination, dust, oil, moisture, or uneven application area;
  • improper storage, transport, or handling after delivery; or
  • any application or installation method not carried out by us.

12. Inspection, Acceptance, and Claims

You must inspect the delivered or collected product promptly upon receipt.

Any complaint for alleged defect, shortage, wrong item, or production error must be submitted to us within three (3) Working Days from the date of receipt or collection, together with clear supporting evidence reasonably requested by us, including photographs, videos, packaging images, and order details.

No claim will be entertained if:

  • the claim is made after the above period;
  • the product has already been installed, applied, mounted, used, altered, cut, sewn, laminated, reworked, or otherwise processed by you or any third party;
  • the issue arises from your file, design, content, or instructions; or
  • the alleged issue falls within normal tolerance, industrial limitation, or accepted variation.

If no claim is raised within the above period, the order shall be deemed accepted by you as complete and satisfactory.

13. Refund, Reprint, and Remedies

13.1 No Change-of-Mind Refund

Because our products are custom-made and/or made-to-order, we do not accept refunds, returns, or exchanges for:

  • change of mind;
  • customer mistake;
  • file error;
  • spelling error;
  • content error;
  • colour dissatisfaction within normal variance;
  • layout dissatisfaction where based on a customer-supplied file;
  • attempts to exploit policy loopholes; or
  • bad-faith or abusive refund demands.

13.2 Factory-Caused Production Error

If, after review, we determine that a material issue was caused directly by our production process and falls outside normal tolerance, our primary remedy shall be, at our option:

  • free reprint;
  • partial refund; or
  • full refund.

Before any free reprint, refund, replacement, or other remedy is provided, we reserve the right to require that you:

  • return the allegedly defective products to us;
  • preserve the products for inspection;
  • provide clear photographic or video evidence; and/or
  • provide proof of destruction where return is impractical.

If the products have already been used, installed, applied, mounted, resold, or otherwise utilised for their intended purpose, we reserve the right to reject any refund, reprint, or replacement request.

13.3 Non-Factory Issues

If the issue is not caused by our production negligence, any goodwill solution offered by us, including partial refund, discount, rework, replacement, or store credit, shall be entirely at our discretion and shall not set any precedent for future cases.

14. Delivery, Collection, and Risk Transfer

14.1 Third-Party Logistics

Shipping and delivery may be performed by third-party logistics providers. Once the parcel is handed over to the courier, delivery timing and handling are outside our direct control.

14.2 Transfer of Risk

Risk of loss, delay, damage, or misdelivery transfers:

  • upon handover to the courier; or
  • upon readiness for customer pickup or collection,

whichever occurs first.

14.3 Courier Issues

We may assist in communication or claim support as a goodwill gesture, but we are not liable for courier delay, parcel loss, theft, transit damage, mishandling, failed scan, or service failure caused after dispatch.

14.4 Failed Delivery / Uncollected Orders

If delivery fails due to incorrect information, non-availability of recipient, refusal to receive, restricted access, remote area issues, or any other reason not caused by us, re-delivery, storage, return handling, or related costs may be charged to you.

If an order remains uncollected for thirty (30) days from the date of readiness notification, or if a returned parcel remains unclaimed for thirty (30) days from the date we notify you of its return or availability for recollection, the order shall be deemed abandoned.

We reserve the right to dispose of, destroy, recycle, resell, or otherwise deal with the abandoned items without further notice, and no refund, compensation, or replacement shall be provided.

15. Intellectual Property, Compliance, and Showcase Rights

15.1 Intellectual Property and Unlawful Content

You represent and warrant that all files, artwork, content, and instructions submitted by you:

  • belong to you; or
  • are used with proper authority, licence, or permission.

You must not submit content that:

  • infringes copyright, trademark, patent, design right, or other intellectual property rights;
  • is illegal, obscene, defamatory, hateful, fraudulent, or misleading; or
  • violates any applicable law, regulation, or third-party right.

We reserve the right to reject, suspend, cancel, report, or remove any order involving suspected unlawful or infringing content.

You shall be solely responsible for all consequences arising from such content.

15.2 Local Council Permits and Regulatory Compliance

For any product intended for outdoor display, public display, installation, or regulated use, including but not limited to signboards, banners, buntings, billboards, stickers, wall graphics, and advertising materials, you are solely responsible for:

  • ensuring that the content, wording, language, and design comply with all applicable laws, by-laws, licensing rules, and authority requirements;
  • obtaining any required approvals, licences, permits, or confirmations from local councils, authorities, building management, regulators, or any other relevant party; and
  • ensuring compliance with any applicable Bahasa Melayu / Dewan Bahasa dan Pustaka (DBP) requirements or advertising language rules.

We bear no liability for any rejection, fine, penalty, confiscation, removal, enforcement action, business interruption, or loss arising from your failure to obtain or comply with such approvals or requirements.

15.3 Right to Showcase

Unless you notify us in writing before production begins that the order is confidential and must not be displayed, you grant us a non-exclusive, royalty-free right to photograph, record, and display the completed physical products for our portfolio, case studies, advertising, website, social media, and promotional purposes.

We may, at our discretion, decline any request for confidentiality, anonymity, or non-disclosure in relation to an order unless separately agreed in writing.

16. Indemnity

You agree to indemnify, defend, and hold harmless WA COMM MALAYSIA SDN. BHD., its directors, shareholders, employees, agents, contractors, affiliates, service providers, and representatives from and against any and all claims, losses, liabilities, damages, costs, expenses, fines, penalties, and legal fees arising out of or related to:

  • your files, artwork, or content;
  • infringement of intellectual property or other rights;
  • unlawful, defamatory, misleading, or non-compliant content;
  • your breach of these Terms;
  • your misuse of the Services; or
  • disputes between you and your own customer, client, end-user, contractor, installer, or third party.

17. System Errors, Pricing Errors, and Website Availability

We do not warrant that the website or Services will be uninterrupted, error-free, secure, or always available.

We reserve the right to correct at any time any:

  • pricing error;
  • quotation error;
  • calculation error;
  • Wallet error;
  • stock error;
  • product configuration error;
  • content error;
  • typographical error;
  • upload issue;
  • system bug; or
  • technical error.

If an order is affected by such an error, we may cancel, suspend, revise, reject, or refuse the order, and where appropriate, provide a refund, partial refund, reversal, or alternative arrangement at our discretion.

18. Anti-Abuse, Bad-Faith Claims, and Right to Refuse Service

We reserve the right to reject orders, refuse service, suspend accounts, cancel Wallet privileges, deny claims, or take legal action where we reasonably believe that a customer has engaged in:

  • abusive, insulting, or threatening behaviour;
  • fraudulent payment or chargeback abuse;
  • false allegations;
  • repeated unreasonable claims;
  • refund exploitation;
  • policy loophole abuse;
  • defamatory statements;
  • harassment of our staff; or
  • dishonest or bad-faith conduct.

A customer's dissatisfaction alone does not create liability on our part where the order was produced in accordance with the submitted file, normal tolerance, industrial limitations, and these Terms.

19. Limitation of Liability

To the fullest extent permitted by law:

  • our total aggregate liability arising from any order, product, service, or claim shall not exceed the amount actually paid by you for the relevant order; and
  • we shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage.

This includes, without limitation:

  • loss of profit;
  • loss of business;
  • loss of reputation;
  • loss of opportunity;
  • delay loss;
  • event disruption;
  • downstream customer claims;
  • installation cost;
  • labour cost;
  • advertising cost;
  • third-party penalties;
  • transport cost; and
  • emotional distress.

You acknowledge that our role is limited to manufacturing and fulfilment based on customer-submitted instructions.

Nothing in these Terms shall exclude, restrict, or modify any right or remedy that cannot lawfully be excluded, restricted, or modified under applicable Malaysian law.

20. No Warranty

Except as expressly stated in these Terms, all products and Services are provided on an “as is” and “as available” basis.

We do not guarantee:

  • uninterrupted website availability;
  • perfect customer satisfaction;
  • exact colour match;
  • exact repeat-order matching;
  • zero-tolerance production;
  • suitability for a specific commercial purpose; or
  • compliance with any particular tender, project, landlord, authority, or end-customer standard,

unless expressly agreed in writing.

21. Force Majeure

We shall not be liable for any delay, failure, interruption, or inability to perform arising from events beyond our reasonable control, including but not limited to:

  • natural disaster;
  • flood;
  • fire;
  • storm;
  • pandemic;
  • epidemic;
  • war;
  • riot;
  • civil disturbance;
  • government action;
  • inspection or enforcement activity;
  • material shortage;
  • supply disruption;
  • transportation disruption;
  • utility failure;
  • internet failure;
  • software failure;
  • machine breakdown;
  • labour shortage;
  • industrial action; or
  • public holiday congestion.

22. Suspension and Termination

We may suspend, restrict, or terminate your access to the website, account, Wallet, or Services at any time, with or without notice, if:

  • you breach these Terms;
  • we suspect unlawful conduct;
  • we suspect abusive, fraudulent, or bad-faith activity;
  • your account creates operational, legal, financial, or reputational risk; or
  • we decide to discontinue any part of the Services.

Such suspension or termination shall be without prejudice to any rights or remedies available to us.

23. Personal Data

Your use of the Services may involve the collection, use, disclosure, processing, and storage of personal data. Such matters shall be governed by our Privacy Policy, as published and updated from time to time.

You represent and warrant that any personal data submitted by you, including any third-party personal data contained in artwork, files, lists, photographs, contact details, or instructions, has been lawfully collected and disclosed to us in compliance with applicable law, including the Personal Data Protection Act 2010 and any amendments thereto.

We shall not be responsible for verifying the authenticity, ownership, accuracy, or lawfulness of any personal data supplied by you.

24. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Malaysia.

Any dispute, controversy, or claim arising out of or in connection with these Terms or the Services shall first be attempted to be resolved amicably.

Subject to any rights available under applicable law that cannot be excluded, restricted, or modified, such dispute shall be subject to the exclusive jurisdiction of the Courts of Malaysia.

For users who qualify as consumers under applicable law, nothing in these Terms is intended to exclude any right to bring a claim before the Tribunal for Consumer Claims Malaysia where such Tribunal has jurisdiction.

25. Miscellaneous

25.1 Entire Agreement

These Terms constitute the entire agreement between you and us in relation to the Services and supersede any prior discussion, communication, representation, quotation language, website statement, or understanding relating to the same, except where expressly confirmed by us in writing.

25.2 Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

25.3 Waiver

Any failure or delay by us in exercising any right shall not operate as a waiver of that right.

25.4 Language

If these Terms are translated into another language, the English version shall prevail in the event of any inconsistency, unless otherwise expressly stated by us.

25.5 Assignment

You may not assign, transfer, novate, or otherwise deal with your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to any related company, successor, purchaser, or transferee of the business or relevant assets.
